All rebuilt engines including Japanese engines purchased from us come with a full 3 year UNLIMITED rebuilt engine warranty. If we install your rebuilt engine, we will include a 6 month labor warranty as well. Our guarantee to you is that we offer the best prices and use only the highest quality parts which will ensure your safety and investment for years to come. **ES Engines.com Limited Warranty**
The original invoice and this document must be presented in order for this warranty to be honored by ES Engines.com
This warranty is free and not billed to the customer
*Oil & Oil Filter must be changed at first 500 miles (Do not use Synthetic Oil). Afterwords oil & oil filter must be changed every 3,000 miles as part of regular maintenance.
*Oil Change receipts will be requested if a warranty claim arises. Without sufficient paperwork regarding oil changes or maintenance, ES Engines.com will NOT honor any claim
*For the first 500 Miles, DO NOT drive your vehicle above 75 MPH as part of the break in period.
*You have 36 months warranty unlimited miles on the engine
*6 months warranty on labor if installed at ES Engines.com.
*If ES Engines.com does not perform installation on your vehicle, no compensation for labor charges will be granted under any circumstances.
*If ES Engines.com performs installation on your vehicle, it is only liable for the engine replaced and not for any part in the vehicle [e.g Transmission, Brakes, Tires]
*Estimated Handling time can range anywhere between 3-10 business days & shipping between 5-14 days [International shipping times vary from 45-60 business day shipping & handling time]
*Shipping & handling time frames begin on the day the buyer pays for the refundable core deposit.
*It is the responsibility of the buyer to inspect all parts received in the engine provided for accuracy upon receipt of the engine.
*If the buyer/mechanic receive a product that is different than what they had originally ordered, and have it installed either way without inspection, it is the mechanic/buyers responsibility to cover any labor charges. ES Engines.com will not cover any labor charges due to shipment of incorrect part/product.
*We recommend installing a brand new water pump with the engine if you are purchasing just the engine itself.
*Please be sure that car radiator and thermostat are in good working condition as ES Engines.com will not be deemed responsible if the engine has overheated or has blown a head gasket.
*Prior to performing the engine swap please be sure no additional parts/accessories need any replacing.
*It is solely the customer’s responsibility to detect that all necessary accessories not pertaining to the long block are in undamaged good working condition prior to the engine swap.
*Please be aware that ES Engines.com is NOT liable for any accessories already in the vehicle which are not functional and that may result in the potential damage of your engine.
*ES Engines.com is in no way liable for any additional expenses endured by the owner [e.g replacement of parts, storage fees, towing fees]
*Should any engine and/or part received be deemed inaccurate,ES Engines.com will replace the engine and/or part for the buyer.
*Buyer is responsible to pay half the original shipping cost when shipping back the core.
*If in the event that the engine provided is deemed defective and/or inaccurate by the customer, the customer is responsible to ship back merchandise at his/her own expense prior to receiving the correct engine.
*No merchandise will be shipped prior to receiving and inspecting original engine and/or part at the ES Engines.com facility.
*Buyer is fully responsible to pay return shipping cost on any merchandise received from ES Engines.com if he/she wishes to return merchandise for exchange.
*All Engines and/or parts returned will be inspected for accuracy and must be in undamaged condition for an exchange.
*All Engine sales are final, and no full refunds will be granted under any circumstances 14 days after receipt of product.
*ES Engines.com holds the right to refuse reimbursement of the core deposit if the engine is deemed non rebuildable.
*Warranty is VOID if customers fail to comply with vehicle services stated above.
*Refundable Core Deposits will be refunded up to 45 days of the core arrival date.
*If in the event that any issue arises under Warranty, the buyer should ship back the original motor and in exchange will receive the identical engine back expect in good working condition.
*Any warranty issues must be submitted by engine owner through the Main Contact Form at http://ES Engines.com.com /
*All ES Engines.com customers are expected to have read and fully acknowledge this warranty prior to making their engine purchase.
*Customer hereby agrees to payout ANY arbitration costs to ES Engines.com if a warranty issue is to arise within the contract period.
*THESE TERMS SHALL BE CONSTRUED AND ENFORCED IN ACCORDANCE WITH THE LAWS OF THE STATE OF CALIFORNIA AND THE UNITED STATES OF AMERICA WITHOUT REGARD TO ANY CHOICE OF LAW OR CONFLICT OF LAWS PRINCIPLES, REGARDLESS OF WHERE YOU LIVE. ALL ACTIONS OR PROCEEDINGS ARISING IN CONNECTION WITH, TOUCHING UPON OR RELATING TO THESE TERMS, OR THE SITE, OR THE BREACH OF THESE TERMS AND/OR THE SCOPE OF THE PROVISIONS OF THIS ARBITRATION CLAUSE, SHALL BE SUBMITTED TO ES Engines.com (“ES Engines.com”) FOR FINAL AND BINDING ARBITRATION UNDER ITS STREAMLINED ARBITRATION RULES, TO BE HELD IN LOS ANGELES COUNTY, CALIFORNIA, BEFORE A SINGLE ARBITRATOR WHO SHALL BE A RETIRED JUDGE, IN ACCORDANCE WITH CALIFORNIA CODE OF CIVIL PROCEDURE §§ 1280 ET SEQ. THE ARBITRATOR SHALL BE SELECTED BY MUTUAL AGREEMENT OF THE PARTIES OR, IF THE PARTIES CANNOT AGREE, THEN BY STRIKING FROM A LIST OF ARBITRATORS SUPPLIED BY ES Engines.com. THE ARBITRATION SHALL BE A CONFIDENTIAL PROCEEDING, CLOSED TO THE GENERAL PUBLIC. THE ARBITRATOR SHALL ISSUE A WRITTEN OPINION STATING THE ESSENTIAL FINDINGS AND CONCLUSIONS UPON WHICH THE ARBITRATOR'S AWARD IS BASED. THE ARBITRATOR SHALL HAVE THE POWER TO ENTER TEMPORARY RESTRAINING ORDERS AND PRELIMINARY AND PERMANENT INJUNCTIONS. NEITHER PARTY SHALL BE ENTITLED OR PERMITTED TO COMMENCE OR MAINTAIN ANY ACTION IN A COURT OF LAW WITH RESPECT TO ANY MATTER IN DISPUTE UNTIL SUCH MATTER SHALL HAVE BEEN SUBMITTED TO ARBITRATION AS HEREIN PROVIDED AND THEN ONLY FOR THE ENFORCEMENT OF THE ARBITRATOR'S AWARD.
* YOU UNDERSTAND THAT TO THE EXTENT PERMITTED UNDER APPLICABLE LAWS, IN NO EVENT WILL ES Engines.com OR ANY OF ITS AFFILIATES OR ANY OF THEIR RESPECTIVE OFFICERS, EMPLOYEES, DIRECTORS, SHAREHOLDERS, AGENTS, OR LICENSORS BE LIABLE TO YOU OR ANYONE ELSE UNDER ANY THEORY OF LIABILITY (WHETHER IN CONTRACT, TORT, STATUTORY, OR OTHERWISE) FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF REVENUES, PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF SUCH PARTIES WERE ADVISED OF, KNEW OF OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM MISUSE OF EQUIPMENT BY OWNER.
